05What trademark clearance means

Trademark clearance is more than checking whether an identical name appears in a database. It is a broader review of potentially conflicting trademark rights and how similar names are being used in the marketplace.

A comprehensive clearance process may examine federal, state, and international trademark records, as well as business names, domains, websites, online marketplaces, and other common-law use. The findings should then be considered in relation to the relevant goods or services, markets, and legal risks.
