The free search is intended as an early screening step. It includes:

  • Trademark class suggestions based on a description of the goods or services.
  • Exact-name and generated name-variation searching.
  • Preliminary conflict information for results found.
  • A Preliminary Registration Outlook where available for supported USPTO records.

02What does “free” not mean?

A free search does not mean the name has been legally cleared. Trademark availability cannot be determined from a single identical-word search, and no automated result can guarantee that an application will register.

The free search does not replace:

  • A comprehensive clearance search.
  • A review of unregistered and common-law use.
  • Advice from a qualified attorney.
  • A decision by the trademark office examining an application.

03How to get a useful result

For the most useful preliminary search:

  1. Enter the name exactly as you plan to use it.
  2. Describe the products or services you plan to offer.
  3. Review the suggested classes instead of accepting them blindly.
  4. Examine similar records, not only identical names.
  5. Pay attention to goods, services, status, owner, and jurisdiction.
  6. Investigate important results before making a filing or launch decision.

The free search provides a preliminary view of potential conflicts. The Detailed USPTO Report adds a downloadable, more detailed review of supported USPTO findings.

05When to go beyond a free search

Consider further investigation when:

  • Similar marks appear for related goods or services.
