How Zylmark builds a preliminary trademark search

Before you begin

Zylmark turns a proposed name and a description of the goods or services into a structured preliminary trademark search. This page explains how class suggestions, name variations, supported databases, result organization, and the Preliminary Registration Outlook fit together.

01Supported trademark databases

Zylmark searches USPTO, EUIPO, WIPO, and additional trademark databases. Check out the full list of databases we cover.

Each database represents a particular jurisdiction or collection of trademark records. Coverage, available record fields, and update timing can vary by source. When a result matters to your decision, open the underlying official record and review its current details.

02What you provide

Begin with the name you want to search and a clear, everyday description of the goods or services you plan to offer. Describe the specific product or service instead of entering only a broad label such as “technology” or “retail.”

Zylmark uses this description to suggest potentially relevant trademark classes and provide context for the preliminary search. A more specific description can make those suggestions more useful, but you should still review them before relying on them.

03How class suggestions work

Trademark classes group different kinds of goods and services. Zylmark uses your description to suggest classes that may be relevant to your offering and can help focus the preliminary search.

Class suggestions are a starting point, not a filing decision. Review the wording and consider whether your business operates in more than one class. You can also use the free Trademark Class Finder to browse active descriptions from the USPTO Trademark ID Manual.

04How Zylmark searches name variations

An exact-name search can miss marks that look or sound similar. Zylmark broadens the preliminary search beyond the exact wording by looking for:

  • The exact name entered.
  • Generated spelling or phonetic variations.
  • Potential visual-text similarities.

Generated variations can help surface records for review, but no automated search can guarantee that every legally relevant variation will appear. A logo or design mark may also require separate image and design-code search methods.

05How results are organized

Zylmark brings potentially relevant records into one review flow. Depending on the source and record, the available details may include the mark, status, owner, goods and services, class, application or registration identifiers, jurisdiction, and important dates.

A similar result does not automatically mean that the names conflict. Review the full record, the related goods or services, and the current status before deciding what the result means for your proposed name.

06How to use the Preliminary Registration Outlook

Zylmark’s Preliminary Registration Outlook helps you understand how potential conflicts found in supported USPTO records may affect your registration prospects. It may be shown as Favorable, Mixed, or Caution, based on the potential conflicts identified in the search.

Use the outlook to prioritize further review. It is not a prediction, legal opinion, or USPTO decision. Always examine the underlying trademark records and consider the similarity of the names together with the related goods or services.

07Detailed USPTO Report

The Detailed USPTO Report provides a downloadable, more detailed way to organize and review findings from supported USPTO records. Available separately for $49.99.

It is part of a preliminary screening process, not a legal opinion, and does not replace an attorney's review or a broader clearance investigation when one is appropriate.

08Important limitations

Keep these limits in mind when using any preliminary trademark search:

  • Database coverage and freshness vary.
  • Automated variation generation can miss relevant marks.
  • Classification suggestions can be incomplete or incorrect.
  • Federal databases do not include all common-law use.
  • A different class does not automatically remove potential conflict.
  • Search results are not legal advice or guaranteed clearance.
  • Official records and qualified professional advice should be consulted when appropriate.
